Terms of Service
Last updated: June 19, 2026. Please read these terms carefully before using Falah.
1. Acceptance of Terms
These Terms of Service ("Terms") govern your use of the Falah mobile application ("the App") provided by Mykoala Pty Ltd ("we", "us", "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.
2. Changes to These Terms
We may update these Terms from time to time. We will publish the updated version on this page and update the "Last updated" date above. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.
3. Licence to Use the App
3.1 Licence Grant
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App for your own personal, non-commercial use, subject to these Terms.
3.2 Restrictions
You agree not to:
- Copy, modify, distribute, sell, or lease any part of the App or its content
- Reverse engineer, decompile, or attempt to extract the source code, except as permitted by applicable law
- Use the App to provide services to third parties on a commercial basis without our written consent
- Remove or alter any proprietary notices or labels in the App
- Use the App in any way that violates applicable laws or regulations
3.3 Updates
We may release updates from time to time. Some updates may be required for the App to continue functioning correctly. We recommend keeping the App updated to the latest version.
4. Intellectual Property
The App, including all content, features, design elements, and code, is owned by Mykoala Pty Ltd or its licensors and is protected by Australian and international intellectual property laws.
Quran text used in the App is sourced from open, public-domain translations. Audio content (adhan recordings) is used under licence. Prayer time calculations use the adhan open-source library. These third-party components are subject to their own respective licences. Your use of the App does not grant you any ownership rights in the App or its content.
5. Subscriptions and Payments
5.1 Available Plans
Falah Pro is offered as an auto-renewing subscription. Current plans and prices are shown on our Pricing page and at the point of purchase in the App Store or Google Play. Prices are displayed in US dollars on this website; your local price is set by the App Store based on your region and includes applicable taxes.
5.2 Auto-Renewal
Subscriptions are auto-renewable. Your subscription will automatically renew at the end of each billing period unless you cancel it at least 24 hours before the end of the current period. Payment will be charged to your Apple ID or Google Play account at confirmation of purchase and at the start of each renewal period.
5.3 Free Trial
If we offer a free trial for any plan, you will not be charged until the trial ends. If you do not cancel before the trial ends, you will be charged at the rate disclosed at sign-up. Cancelling during the trial will not result in a charge.
5.4 How to Cancel
iOS (App Store): Settings → [Your Name] → Subscriptions → Falah → Cancel Subscription.
Android (Google Play): Open Google Play → profile icon → Payments & subscriptions → Subscriptions → Falah → Cancel Subscription.
Cancellation takes effect at the end of the current billing period. You retain access to premium features until that date. Step-by-step guides are on our support page.
5.5 Price Changes
We may change subscription prices at any time and will give reasonable advance notice. If you do not agree to a price change, you should cancel before the change takes effect.
5.6 Restoring Purchases
If you reinstall the App or switch devices, you can restore your purchase using the "Restore Purchases" function within the App. This requires you to be signed in to the same Apple ID or Google account used for the original purchase.
6. Refunds
All purchases of Falah subscriptions are processed by Apple (App Store) or Google (Google Play). We do not process refunds directly. Refund eligibility is governed entirely by the refund policy of the relevant platform. If you have a billing dispute, please contact Apple or Google directly. We are unable to issue credits, refunds, or partial refunds on their behalf.
7. Charitable Allocation (Zakat)
7.1 Our Commitment
A portion of subscription revenue generated by Falah is allocated as zakat — the obligatory act of charity that is one of the Five Pillars of Islam — to Muslim communities in Fiji. This distribution is made through the developer's personal family network and local mosque connections in Fiji, verified through ongoing community relationships.
7.2 What This Is Not
This charitable allocation is not a registered charitable donation:
- Mykoala Pty Ltd is not a registered charity or deductible gift recipient (DGR) under Australian law.
- You do not receive a tax deduction for any portion of your subscription payment.
- This is a personal and voluntary commitment by the developer — a reflection of religious obligation and community connection — not a legally binding contractual obligation to any third party.
8. User Responsibilities
You are responsible for ensuring your device meets the minimum requirements to run the App, keeping your device and store account credentials secure, using the App in compliance with all applicable laws, and any internet costs. The App provides prayer time calculations based on well-established astronomical and jurisprudential methods; you are responsible for verifying prayer times locally, particularly in edge cases (polar regions or unusual geographic circumstances). See Section 10 for our disclaimer on prayer time accuracy.
9. Privacy
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. In summary: Falah's core app stores your data (location, preferences, streak) on your device only and creates no account. The optional Falah Pro tier uses an email magic-link sign-in to unlock premium content, and production builds include crash diagnostics not linked to your identity.
10. Disclaimer of Warranties
Prayer time accuracy: Prayer times in Falah are calculated using the adhan open-source library, applying widely used jurisprudential calculation methods. Calculations are astronomical estimates and may differ from times announced by local mosques, particularly during edge-case conditions. You should verify prayer times with a local authority for obligatory prayers.
General disclaimer: To the maximum extent permitted by applicable law, the App is provided "as is" and "as available" without warranty of any kind. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. Nothing in this clause limits any rights you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)), which cannot be excluded by contract.
11. Limitation of Liability
To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App. Our total aggregate liability for any claim is limited to the amount you paid for the App in the 12 months immediately preceding the claim. Nothing in this clause excludes liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded under the Australian Consumer Law.
12. Third-Party Services
The App integrates with third-party services including the subscription platform (RevenueCat), Apple App Store, Google Play, and OpenStreetMap. These services are governed by their own terms and privacy policies. We are not responsible for the terms, availability, or data practices of any third-party service.
13. Termination
You may stop using the App at any time by uninstalling it and cancelling any active subscription as described in Section 5.4. We may suspend or terminate your access to premium features if you materially breach these Terms, if we are required to by law, or if we discontinue the App. If we discontinue the App and you have remaining paid time, we will endeavour to provide a pro-rata refund where possible, subject to Apple's and Google's policies.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of New South Wales, Australia, without regard to conflict of law principles. Nothing in these Terms limits any non-excludable rights you have under the Australian Consumer Law.
15. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede any prior agreements.
